1. About these Terms

These Terms of Use (the “Terms”) form a binding agreement between you and promptgame.ai (“promptgame.ai”, “we”, “us”, or “our”). They govern your access to and use of the promptgame.ai website, applications, and services (together, the “Service”).

By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. The Service

promptgame.ai is an interactive learning platform that teaches AI prompting skills through quests, lessons, leaderboards, and certificates. The Service includes free content (the “Free” tier) and paid content (the “Premium” tier and team plans).

We are continuously improving the Service. We may add, remove, or change features, content, quests, certificates, and pricing at any time. We will give reasonable notice for material changes that affect paid subscribers.

3. Eligibility and accounts

You must be at least 13 years old to create an account. If you are under 18, you must have a parent or legal guardian's permission. The Service is designed for users aged 18 and older.

You agree to provide accurate, current, and complete information when you create an account, and to keep that information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately through the contact options on promptgame.ai if you suspect unauthorized access.

4. Acceptable use

You agree not to:

• Use the Service for any unlawful, harmful, fraudulent, or abusive purpose.
• Attempt to access another user's account, data, or certificates without authorization.
• Reverse-engineer, decompile, scrape, or otherwise attempt to extract source code or copyrighted content from the Service.
• Resell, sublicense, or redistribute the Service or its content without our written permission.
• Use automated systems (bots, scrapers, headless browsers) to access the Service or to inflate points, streaks, or leaderboard rankings.
• Submit content that is illegal, infringing, defamatory, harassing, hateful, sexually explicit, or that contains malware or harmful code.
• Bypass or attempt to bypass paywalls, rate limits, or other protective measures.

We may suspend or terminate accounts that violate these rules.

5. Subscriptions and billing

Some features of the Service require a paid subscription. By subscribing, you authorize us (and our payment processor, Stripe) to charge your chosen payment method on a recurring basis until you cancel.

Personal subscriptions. Premium is offered monthly ($47/month) or annually (billed yearly at a discount). Prices are in U.S. dollars and exclude applicable taxes.

Team subscriptions. Organizations purchase seats in bulk. Volume discounts apply automatically based on the number of seats. The organization's admin is responsible for managing billing, seat count, and member activation.

Auto-renewal. Subscriptions renew automatically at the then-current price for the same billing period unless you cancel before the renewal date.

Price changes. We may change subscription pricing. Changes will not affect your current billing period and we will notify you by email at least 30 days before the change takes effect.

Failed payments. If a payment fails, we may suspend access until payment succeeds. Repeated failures may result in cancellation.

6. Cancellation and refunds

You can cancel any time. Cancel from your account settings or by contacting us through promptgame.ai. Cancellation takes effect at the end of your current billing period. You retain access to paid features until that date.

Monthly subscriptions: No refunds for partial months. Cancellation stops the next renewal.

Annual subscriptions: Full refund within 14 days of purchase or renewal, no questions asked. After 14 days, cancellation takes effect at the end of your annual term and we do not provide partial refunds.

Team subscriptions: The org admin can reduce seat count or cancel at any time. Reductions take effect at the next billing period. The same 14-day refund window applies to annual team plans.

We may issue refunds outside this policy at our sole discretion, for example in cases of extended service outages or billing errors.

7. Intellectual property

The Service, including all quests, lessons, narrative content, graphics, designs, software, certificates, and trademarks, is owned by promptgame.ai or its licensors and is protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial learning, or for the internal business purposes of an organization that has purchased seats.

All rights not expressly granted to you are reserved by promptgame.ai.

8. Your content

When you submit content to the Service (for example, prompts you type into lessons, profile information, or display name), you retain ownership of that content. You grant us a worldwide, royalty-free, non-exclusive license to use, copy, store, transmit, and display your content solely for the purpose of operating, providing, and improving the Service.

We may use anonymized, aggregated data derived from your use of the Service to improve our product, train our models, and report statistics. We will not use any content that personally identifies you for marketing without your consent.

You are responsible for the content you submit. Do not submit confidential, sensitive, or third-party content you don't have the right to share.

9. Certificates

Certificates earned on promptgame.ai represent that you have completed a specific realm, including its boss challenge. Certificates are issued for personal achievement, are not transferable, and may be displayed publicly (for example on LinkedIn) by the user who earned them.

We may revoke certificates if we determine they were earned through cheating, automation, or violation of these Terms.

10. Third-party services

The Service relies on third-party providers including, but not limited to, Stripe (payment processing), Vercel (hosting), and Supabase (data storage and authentication). Your use of those services may be subject to their own terms and privacy policies. We are not responsible for the actions or omissions of third-party providers.

The Service may also link to third-party websites (LinkedIn, GitHub, etc.). We are not responsible for the content or practices of those websites.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

We do not warrant that the Service will be uninterrupted, error-free, secure, or that defects will be corrected. Educational content is for general informational purposes and is not professional advice. AI prompting techniques and the underlying models change rapidly; we make no guarantees about the effectiveness or accuracy of any specific technique in any specific context.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, promptgame.ai AND ITS OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, REVENUES, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO promptgame.ai IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, the limitations above apply to the fullest extent permitted by law.

13. Indemnification

You agree to indemnify, defend, and hold harmless promptgame.ai and its officers, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your violation of these Terms, (b) your misuse of the Service, or (c) your violation of any third-party rights, including intellectual property rights.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, including if you violate these Terms. Upon termination, your right to use the Service ends immediately. Provisions that by their nature should survive termination (including ownership, disclaimers, indemnity, and limitations of liability) will survive.

You may terminate your account at any time by canceling your subscription and deleting your account from your profile settings, or by contacting us through promptgame.ai.

15. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, U.S.A., without regard to its conflict-of-laws principles. Any dispute arising under or related to these Terms or the Service will be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.

We will attempt to resolve any dispute informally first. Please contact us through promptgame.ai before filing a formal claim.

16. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes your acceptance of the updated Terms.

17. Miscellaneous

Entire agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and promptgame.ai regarding the Service.

Severability. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force.

No waiver. Our failure to enforce any right or provision is not a waiver of that right.

Assignment. You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
